Berkeley County Building Commission

The Berkeley County Building Commission ("Building Commission") was created pursuant to Chapter 8, Article33 of the West Virginia Code of 1931, as amended, by an order entered by the County Commission of Berkeley County, West Virginia ("County Commission") on the 4th day of September 1979. The Building Commission finances the purchase and construction of capital assets for the County Council and leases them to the County Council and others. Ownership of the assets passes to the County Council when the bonds mature and are returned. The lease or loan payments the Building Commission receives are used to pay the revenue bonds' principal and interest. The Building Commission is composed of five (5) members and meets on an as-needed basis.

Berkeley County Criminal Justice Board

The Berkeley County Community Criminal Justice Board (CCJB) established under WV Code §62-11C-6 is empowered to develop, establish, administer, monitor, and maintain community-based corrections programs for those who meet the eligibility criteria. Through oversight of the Berkeley County Day Report Center, the CCJB works with law enforcement, the judiciary, government agencies and community resources to reduce criminal recidivism rates by providing participants with the opportunity to learn about his/her behavior, acquire needed skills to address problematic issues, and develop life tools to insure long-term success while enhancing community safety. By law, the Berkeley County Community Criminal Justice Board cannot have more than fifteen (15) members and all members must be a resident of Berkeley County. Meetings are regularly scheduled for the third Wednesday of each month, unless otherwise posted, at 4 PM.

Berkeley County Farmland Preservation Board (BCFPB)

The Berkeley County Farmland Protection Board works to preserve important farmland and properties with significant conservation values by acquiring conservation easements on those lands. We do this either by the outright purchase of an easement or by accepting a donation. Once an easement has been established, the board continues to monitor the property annually to ensure that the terms and conditions of the easement are being honored. Civil Service Commission

All duties of the Civil Service Commission is listed in Chapter 7-14 of West Virginia State Code. A clip note version would be that the board is comprised of three Commissioners, one appointed by the bar association, one by the County Council, and one by the Deputy Association. The three body council has the power to form Rules and Regulations for the Berkeley County Sheriff that dictates how all hiring, promotions, and disciplinary actions will be handled within the department, in accordance with WV State Code. The Commission administers all testing for the Berkeley County Sheriff Department, and certifies the top scores, and provides the list of those certified as eligible to the sheriff.  If an applicant or deputy feel that they we not considered for hire or promotion fairly, they are entitled to a public hearing. At the hearing, it is the burden of the sheriff to provide evidence as to why the applicant wasn’t considered for hire. If  disciplinary action is taken against a deputy, and the deputy does not agree with that punishment, the sheriff must prove why the action was taken. The Commission then has the power to either agree with or disagree with the Sheriff’s actions, and that time either party, if they choose to take it farther can appeal in the Circuit Court. The County Clerk’s office, provides all secretarial needs for the Commission, in terms of taking meeting minutes, recording of hearings, putting out job announcements/promotion announcement, and calculating all scores for each applicant/deputy.

Eastern Panhandle Home Consortium

The Eastern Panhandle HOME Consortium of West Virginia was formed in 2006 to enable the Cities and Counties of the Eastern Panhandle to receive HOME Investment Partnership Program funds from the U.S. Department of Housing and Urban Development.HOME funds are used to provide affordable housing opportunities for low income households.The HOME Consortium receives approximately $324,000 per year.The primary use of HOME funds has been to provide the Homebuyer Assistance Program providing interest-free,deferred payment loans for downpayment and closing costs to low-income first-time homebuyers.To date 225 households have been assisted (110 in Berkeley County;32 City of Martinsburg;56 in Jefferson County; and 27 in Morgan County).

Local Emergency Planning Committee LEPC

Under the Emergency Planning and Community Right-to-Know Act (EPCRA), Local Emergency Planning Committees (LEPCs) must develop an emergency response plan, review the plan at least annually, and provide information about chemicals in the community to citizens. Plans are developed by LEPCs with stakeholder participation. There is one LEPC for each of the more than 3,000 designated local emergency planning districts. The LEPC membership must include (at a minimum): Elected state and local officials Police, fire, civil defense, and public health professionals, Environment, transportation, and hospital officials Facility representatives, Representatives from community groups and the media.

Martinsburg / Berkeley County Recreation Board

The governing board for M-BC Parks & Recreation is comprised of nine members, three each appointed by the City, the County, and the Board of Education. These individuals are volunteers who set the policy for recreation and park services in Berkeley County. Parks & Recreation receives an annual allocation from each of the three governing bodies for the operation of recreation programs and parks and facilities maintenance. Parks & Recreation also receives a portion of City and County Hotel/Motel tax (paid by occupants of the motels and hotels in the city and county). Parks & Recreation continues to self-generate approximately 70% of its annual operating budget through programs, leagues, facilities, special events, and private and corporate sponsorships. Solid Waste Authority

Berkeley County Solid Waste has methodically worked to implement a series of education, enforcement and solid waste collection programs. Components of those programs were implemented with the primary objective of following the integrated solid waste management hierarchy mandated by the West Virginia Solid Waste Management Act. This Act requires that source reduction, reuse, recycling and recovery take priority in the management of solid waste. Meetings are regularly scheduled for the third Wednesday of each month, unless otherwise posted, at 7 PM.
